DEFINITIONS
The Artist is a person or entity that submits an entry form to the prize, which requires acceptance of these Terms and Conditions to be processed by the website.
The Sponsors include all partners and supporters, and any additions to this will be announced via the website or newsletter.
The Organisers are Oaktree & Tiger, and Art Prize. If you have any queries, please contact us at [email protected]
THE ARTIST
There are no restrictions based on age, training, nationality or where you live.
You must not already have exclusive representation.
You can submit up to 5 different artworks, of any medium including paintings, photography, mixed media, sculpture, etc.
You must be the owner of the submitted artworks and the work(s) submitted are of your own origination. You must hold all moral and intellectual property rights in the submitted artworks.
The entry fee is non-refundable after 14 days of submission, as we will have processed the entry by the end of that period. The Artist must check the Terms & Conditions carefully and any other criteria. The Artist may request a refund if under exceptional circumstances and will be entirely at the discretion of the organisers.
The Organisers cannot guarantee the Judging Panel members in any way, even if specified by the Artist in the submission form, but will endeavour to notify The Artist of any changes within 15 days. The Artist accepts that their submission is not dependent on the Judging Panel members.
The Organisers will compile correctly submitted entries and send to the Judges. The Organisers guarantee at least one judge will view every entry. The Organisers guarantee each correctly uploaded image file is viewed by at least one judge, but cannot guarantee every link and other content is viewed.
By submitting the digital entry form, you accept that if successful in stage 1 the selected artwork(s) must be available in order to proceed to stage 2 and be delivered for physical exhibition and display as part of the shortlist exhibition. Dates for the delivery window will be given to you before the shortlist has been selected and confirmed. The Organisers will contact you to confirm the artwork's availability before confirming you to proceed to stage 2.
The Artist agrees to allow The Organisers to share details from the entry form with our partners, supporters and sponsors. This includes submitted personal data limited to full name, website, social media profiles, email and phone number.
The Artist, upon submitting their entry and payment, is not restricted in selling or exhibiting the artwork themselves until they are invited to be Shortlisted in stage 1 onwards, and The Artist will be contacted by The Organisers specifically to check this.
The Organisers may need to adjust the schedule of the prize, including announcement dates and exhibition dates, and will update the website with at least 7 days' notice of any changes.
For any artworks submitted to the competition, you are not restricted in selling it, exhibiting it or any similar activity. But we ask you that you notify us if it is sold or changes ownership, or changes in any way. The entry fee is non-refundable, but you may notify us if you wish to remove the artwork or application from consideration by The Organisers and Judging Panel.
Once The Artist has submitted their entry form and made payment, no changes or additions will be allowed. The Artist may submit additional or new entries but will have to pay the entry fee as a completely new entry for these to be considered.
The Organisers will promote one artwork from each confirmed and correct application by the Artist, at its sole discretion, and as long as the image doesn't violate any social media platform's terms and conditions of use (e.g. explicit images, offensive, nudity, etc.). We reserve the right to adjust images for censoring purposes in order to not violate the terms and conditions of social media platforms that we are using.
The Organisers endeavour to take care of your work, but will not be liable for any loss or damage to any artworks physically submitted at any point, however caused, whether in transit to and from the exhibition, or during any period of storage, packing or unpacking, exhibition or in any period in which the work is in their or the Sponsor's keeping.
The exhibiting venues endeavour to have insurance in place for while the artworks are on display and this coverage is for the ‘insurable value’ of the artwork and up to a maximum of £10,000 per artwork. The ‘insurable value’ can be different to the sale price authorised by the Artist. We recommend that The Artist takes out insurance to cover the artwork, especially for in transit and while being handled. In any case, having insurance is not obligatory for The Artist’s entry into the prize. If in any doubt, please contact the Organisers.
The Organisers recommend that you take out insurance to cover the artwork, especially for while in transit and while at the Sponsor's premises. Having insurance is not, however, obligatory for entry into the competition.
You accept that if shortlisted then all work selected will be exclusively consigned to The Organisers, available for sale in the exhibition(s) and on The Organiser's website until the end of the competition or the artwork is collected by you, and that The Organisers will take a commission of 40% of the total sale price.
The Artist will not hold The Organisers or The Sponsors liable for any cancellation of events or physical exhibitions. The Organisers will confirm status of the exhibition with The Artist if they are are being considered for the shortlist. The Organisers will endeavour to increase promotion of The Artist if they are shortlisted in the event of cancellation of events or physical exhibitions.
The Organisers will specifically ask for exclusive consignment of an artwork by The Artist if required and the artist can decline unless they are being Shortlisted. Entry to the competition doesn't automatically give the Organiser exclusive consignment agreement from the Artist.
The Artist must not execute any sales without permission from The Organisers while under exclusive consignment, and that any payment is made via The Organisers.
The Organisers will take payment from the buyer of the artwork and will pay you (minus the 40% commission on total sale price) within 30 days of the artwork being in possession of the buyer and receipt from the buyer of the proceeds of sale whichever is the later.
If you are being considered for the Shortlist, you will be required to read carefully and sign a Prize Participation Agreement detailing The Organiser’s and your obligations for being Shortlisted, exhibited and promoted. This will be sent in advance of being Shortlisted, and acceptance is required within 3 days of receiving it in order to be confirmed as Shortlisted.
Once registered for this competition, all Artists agree that we, The Organisers and The Sponsors, may all reproduce the Artists' work for purposes of marketing, promotion, discussion and education, in media including catalogues and publications, posters, postcards, websites and social media and on television, and may license, under these conditions to others only for the same purposes, and only in relation to the Ashurst Emerging Artist Prize or promotion of the Artist. The Organisers and The Sponsors also reserve the right to reproduce selected images for non–commercial purposes, for example in the Winners page of the website and catalogues, indefinitely, as a public record.
The Artist agrees to be placed on The Organiser's mailing lists for our email newsletters and any other information that we may send you and grant full permission in accordance with the General Data Protection Regulation. The Artist reserves the right to opt out of this at any time.
The Artist agrees to have their application shared with The Sponsors and the judges, and any other relevant party.
Please note that we do not offer refunds for entries, unless The Organisers cannot accept the entry and that this is at The Organiser’s discretion.
THE ENTRY
A maximum of 5 artworks per Artist may be entered into the competition.
The image submitted must accurately portray the artwork.
The artworks submitted must be available for sale if shortlisted or to be awarded a prize, and the chosen artworks must be available for exhibiting and be sent in to the Ashurst London offices for judging via physical submission on the required dates, at and for all of the exhibition(s) and for the whole exhibition periods. Collection within the exhibition period will not be allowed. Failure to respect this could result in disqualification or revoking of the title and prize.

The image(s) and completed submission form must be submitted online and payment be made by the stated final Deadline. Entries received late will be invalid unless the competition is extended for any reason, when entries received after then but before the new extended date will be valid.
The Judging Panel may change at any time and will be updated on the website within a week of any changes. If you list on your Entry Form a judge that has changed, then you will be sent an email giving you the option to select a new judge. If you wish to cancel your entry, and be refunded your entry fee, based on the departure of any judge you listed in your entry form, then you are able to as long as it is before the Entry Deadline, and you email us stating this clearly.
SUBMITTED ARTWORK REQUIREMENTS
Accepted media include but are not limited to: paintings, drawings, original prints, photography, sculptures, digitally produced artworks, mixed media constructions, video, sound, digital applications and installations.
Performance art is not accepted in this competition, although video art, and any recordings of performances are accepted.
We are not able to accept explicit imagery, including full nudity and offensive images. Please contact us before entering to assess eligibility if in doubt, by email us at [email protected].
Artwork must, if shortlisted for judging, be the same work previously submitted as a digital image and be available for the next stage of judging and, if selected for the exhibition(s), including the whole exhibition period.
Each artwork (even if made of several pieces, e.g. diptychs/triptychs) must not exceed a total of 275cm x 275cm (including the frame) and must not project more than 50cm from the wall. If a sculpture, it can be up to 275cm x 275cm x 200cm.
For new media, video and sound art, you can submit a file of no more than 100Mb in size for the judging process, but we can use much larger files for exhibiting. We recommend you submit a still image and then put a link to the video or sound file in the Artwork Commentary section. This link can be to a website location, Vimeo link, YouTube link, or a WeTransfer link that we will download.
For image files, please ensure they are at under 20Mb in size and at least 2000 x 2000 pixels in size (we don't look at dpi, dots per inch). We prefer JPEG, but any standard image file format is accepted. If you can't check pixel size, then please try to ensure file size is at least 1Mb in size for JPEGs. Feel free to email us with any questions on this.
All work that has been shortlisted must be available for sale solely and exclusively through The Organisers while exhibited. The Artist's recommended sales prices should be carefully considered and at a sensible and fair market value (The Organisers can assist The Artist with valuations), as this will help effectively to promote the Artist and his/her career. Work that is not for sale cannot be Shortlisted for this competition. This condition does not apply to The Artist
OTHER ITEMS
The Artist will receive a confirmation email within 14 days of submission or an email detailing any errors in the submission or with the payment. If paying the submission fee via Stripe or PayPal, The Artist will receive a receipt from them and can record the Transaction ID to query any issues. The Organisers do not issue invoices for entry payments. The Organisers will confirm every payment received via email within 2 weeks of the final deadline.
Within 14 days after entry and The Organisers having received the entry fee (whichever is later), we will confirm (via email only) you have entered correctly. If you don't receive an email then contact us after the 14 day period.
If there are any issues, please contact us via email specifying the email and full name you used in the entry form, along with full details of the issues. We will endeavour to respond within 7 days.
RETURNS POLICY
If you wish to have a refund, you have until 1 February 2021 to request this, by emailing us at [email protected]. We will execute the full refund via the payment method you used and within 14 days. Refund requests should include the email used in the entry form along with the artist name and transaction number in the receipt emailed to you. No refunds are possible after this date as the entry is processed, sent to the judging panel and scheduled for posting on our social media profiles.
Please note, all artists making payments via Stripe and PayPal will receive a receipt by email directly from Stripe or PayPal. The Organisers will send an Entry Confirmation email once the payment is checked and the entry is checked. If you haven't received this please email us after 14 days of submission.
DISCOUNT OFFERS FOR ENTRANTS
All confirmed entrants are offered 20% discounts for one time use at Cass Art and Genesis Imaging subject to terms and conditions described here.
The discount will be emailed to The Artist in the entry confirmation emails, and will contain instructions to obtain the offer. These will be sent out by up to 14 days after the final deadline for entries.
The discount vouchers are for use only by confirmed entrants to the Ashurst Emerging Artist Prize 2021. They can only be redeemed once per person and must be used by 7 February 2021.
The Cass Art offer cannot be used on special promotional days or in conjunction with any other offer, Cobalt Blue Student Card, Viridian Card or the purchase of gift vouchers and event tickets.

NEXT STAGE
Shortlisted artworks must be sent by the dates given on the website. This information will be given to The Artist in full in the email confirming he or she has been shortlisted. Artworks delivered late will not be judged. After the judging for the shortlist has taken place the shortlisted artists will be notified of whether they have been successful or not. If unsuccessful the email will detail the collection dates available for those works not selected, typically a period of 2 weeks at the end of the exhibition.
Your work should, if possible, be submitted in a stiffy bag (see www.stiffybag.com) or other protective packaging with a clear label with the following: Artist Name, Artwork Name, “Ashurst Emerging Artist Prize”. If you have problems with this, please contact The Organiser on [email protected].
All Artists must arrange for their artworks to be collected from Ashurst's London offices at the end of the exhibition, during the dates specified by The Organiser (typically a 2 week period following the end of the exhibition), or they will be liable for a fee of £5 a day to cover storage costs. The Organiser will notify Artists of these dates before the start of the exhibition.
SHORTLISTED AND WINNING ARTISTS
If the Artist is selected as a Winner, The Artist gives permission to The Organisers (on a sole and exclusive basis) to offer the exhibited artworks for sale throughout the exhibition period through various channels and strictly through The Organiser's art dealing team (including both online and offline), unless specifically authorised in writing by The Organisers.
The Choice Award is selected by votes from the Sponsor's employees and alumni and clients. The Organisers reserve the right to select from the top 3 voted Artist's, and this is based on suitability and eligibility for the prizes.
The Winning Artists must work with the Organiser's curators and exhibit the artworks agreed with the Artist. The Artist is expected to produce, provide, deliver and collect the artworks at their own cost.
The Organisers will provide the install team to install and de-install the exhibition, package the artwork and prepare for collection. The Organisers will promote the artist, the exhibition and the artworks on social media, via newsletters, website and any other viable methods. The Organisers will promote the artworks for sale to the public and handle transactions where required.
The Artist must not execute any sales without permission from The Organisers while under exclusive consignment, and that any payment is made via The Organisers.
The Organisers will take payment from the buyer of the artwork and will pay you (minus the 40% commission on total sale price) within 30 days of the artwork being in possession of the buyer and receipt from the buyer of the proceeds of sale whichever is the later.
The prizes are given to the winning artists after the exhibition has been executed, all Terms & Conditions are adhered to, and within 14 days after the Prize Giving Ceremony.
MISC.
If you feel you have not been treated fairly after your acceptance of these terms and conditions of entry, please send us details of your complaint and we will endeavour to review it within 14 days.

NEXT STAGE
Shortlisted artworks must be sent by the dates given on the website. This information will be given to The Artist in full in the email confirming he or she has been shortlisted. Artworks delivered late will not be judged. After the judging for the shortlist has taken place the shortlisted artists will be notified of whether they have been successful or not. If unsuccessful the email will detail the collection dates available for those works not selected, typically a period of 2 weeks at the end of the exhibition.
Your work should, if possible, be submitted in a stiffy bag (see www.stiffybag.com) or other protective packaging with a clear label with the following: Artist Name, Artwork Name, “Ashurst Emerging Artist Prize”. If you have problems with this, please contact The Organiser on [email protected].
All Artists must arrange for their artworks to be collected from Ashurst's London offices at the end of the exhibition, during the dates specified by The Organiser (typically a 2 week period following the end of the exhibition), or they will be liable for a fee of £5 a day to cover storage costs. The Organiser will notify Artists of these dates before the start of the exhibition.
SHORTLISTED AND WINNING ARTISTS
If the Artist is selected as a Winner, The Artist gives permission to The Organisers (on a sole and exclusive basis) to offer the exhibited artworks for sale throughout the exhibition period through various channels and strictly through The Organiser's art dealing team (including both online and offline), unless specifically authorised in writing by The Organisers.
The Choice Award is selected by votes from the Sponsor's employees and alumni and clients. The Organisers reserve the right to select from the top 3 voted Artist's, and this is based on suitability and eligibility for the prizes.
The Winning Artists must work with the Organiser's curators and exhibit the artworks agreed with the Artist. The Artist is expected to produce, provide, deliver and collect the artworks at their own cost.
The Organisers will provide the install team to install and de-install the exhibition, package the artwork and prepare for collection. The Organisers will promote the artist, the exhibition and the artworks on social media, via newsletters, website and any other viable methods. The Organisers will promote the artworks for sale to the public and handle transactions where required.
The Artist must not execute any sales without permission from The Organisers while under exclusive consignment, and that any payment is made via The Organisers.
The Organisers will take payment from the buyer of the artwork and will pay you (minus the 40% commission on total sale price) within 30 days of the artwork being in possession of the buyer and receipt from the buyer of the proceeds of sale whichever is the later.
The prizes are given to the winning artists after the exhibition has been executed, all Terms & Conditions are adhered to, and within 14 days after the Prize Giving Ceremony.
